Injuries caused by the deliberate or negligent acts of a person or corporate body or hospital, or as a result of a breach of a statutory duty (for example, employers liability) normally give rise to a claim for damages. The amount of those damages of course will vary depending upon the severity of the injuries, the actual financial losses sustained such as loss of earnings, and the degree of impairment of future earning capacity.
We can advise you as to whether your injuries are likely to give rise to a claim and if so the merits and possible value of that claim. Negotiations can then be commenced (usually with an insurance company) to achieve a satisfactory settlement. If this is not possible we can commence proceedings on your behalf which may ultimately result in the matter being decided by a Court.
We can advise you on the legal costs you should recover from the party at fault and your own liability for legal and other fees at the outset and as we go along with the case.
"NO WIN - NO FEE"
This Firm offers conditional fee agreements, some times called "No Win No Fee". Such agreements are not always suitable to a particular case. Some expenses and/or insurance premiums will be payable although the Solicitors fees are provided for under the agreement.
As from April 2000 public funding is generally not available to assist you in presenting your case, it will only be available in very limited circumstances. These include actions involving a large number of claimants, claims where the costs of investigations are very high and claims arising from deliberate assaults or abuse. If appropriate we can advise you about the availability of such funding.
